ORIF surgery required the doctors to re-align the bone using screws. She also suffered a fractured femur and L2, L3, L4 and L5 fractures in her spine. Most notably, she almost did not survive the Crash, as she had a shattered right kidney and bleeding from her right renal artery and aorta. To save her life, surgeons completely removed her right kidney.

Mr. Howard spent nearly two years litigating this case, seeking to recover all available insurance coverage for her. After the Defendant refused to appear for his deposition, the firm filed multiple motions with the Court. Ultimately, the court held the defendant in contempt after his arrest. The Defendant’s deposition took place in a Wake County jail after he was transferred from the Sampson County Sheriff’s Office. The firm was able to settle the child’s claim for all available insurance coverage. Notably, while Medicaid initially claimed one-third of the minor’s settlement for reimbursement, the firm filed a Motion to reduce the Medicaid lien. Medicaid later agreed to waive its claimed lien. This allowed the client to make a more substantial recovery.
