On-site sales representatives, or inside sales reps, such as with vacation resorts, apartment complexes, condominiums, timeshares, and others are often asked to engage in office duties, on-site tours, marketing events, social events and others in order to promote their product. Frequently these sales representatives are categorized as exempt employees who are not eligible for overtime compensation. However, typically, on-site sales representatives such as at vacation resorts, timeshare communities and apartments are not performing the sort of duties that would exclude them from fair overtime compensation. If you are an on-site sales representative or group of sales reps who are not receiving overtime compensation, contact the North Carolina wage and hour lawyers at Maginnis Howard or submit a new case inquiry here.

It is a common misconception that employees who are paid on a commission basis are exempt from overtime requirements.  While this is sometimes true for outside sales positions, i.e. “door to door salesmen,” inside sales reps who work from the company office are not excluded from overtime unless they are exempt on some other basis. Overtime eligibility is dependent upon the type of tasks performed and not how a person is compensated

North Carolina status as a destination for vacationers has led to a significant number of vacation resorts near the beaches in the Outer Banks and Wilmington area, golf in the Pinehurst and Sandhills areas, as well as the mountains around Asheville.  Vacation workers, particularly sales representatives for timeshares are frequently asked to work long hours without compensation for overtime. The Research Triangle area also has many inside sales positions for large and growing businesses seeking to keep labor costs down while productivity from increased hours worked rises.

If you are a sales representative, resort worker who is not being paid overtime when you are working more than 40 hours per week, contact the Raleigh overtime attorneys of Maginnis Howard at (919) 526-0450 or submit a new case inquiry here.  Maginnis Howard is a North Carolina civil litigation firm with employment attorneys handling wage and hour matters through the Research Triangle area, including Cary, Apex, Morrisville, Wake Forest, Pittsboro and Johnston Counties.  The firm also handles select wage and hour cases throughout the state including vacation and sales rep cases for groups of employees in the Outer Banks, Wilmington, Pinehurst, Sanford, Asheville and other tourism areas of North Carolina.
