Brachial Palsy

Charlotte Brachial Palsy Lawyers

Seeking Compensation for Your Child’s Brachial Plexus Injury

Brachial plexus injuries are a fairly common type of birth injury in which the brachial plexus nerves—a network of nerves near the neck, which control arm sensation and movement—are stretched or torn during the birthing process. This often happens when a doctor or nurse twists the infant’s neck to the side or pulls on the infant while delivering. This can later lead to issues with arm movement, control, and sensation, known as brachial palsy or Erb’s palsy. While most brachial plexus injuries will heal with proper treatment, it is up to the parents to ensure that their child receives the care he or she needs.

The birth of your child should be a joyous occasion, but when a delivery room doctor or nurse’s negligent actions cause your newborn child to suffer serious injuries, the moment can quickly turn into one of the most distressing situations you will have to go through. But you don’t have to go through it alone. Our brachial palsy lawyers have handled countless birth injury cases; we understand how to prove that a medical provider’s negligence caused your child’s injuries—and we know how to fight for the maximum compensation you and your child deserve.

Types of Brachial Plexus Injuries

Not all brachial plexus injuries lead to brachial/Erb’s palsy. Depending on the nature and severity of the injury, your child may suffer mild to moderate to severe effects.

The different types of brachial plexus injuries include:

  • Avulsion: This is the most severe type of brachial plexus injury. It occurs when the brachial plexus nerves are completely torn away from the spinal cord, resulting in total loss of sensation/movement in the affected arm.
  • Rupture: Also considered one of the most serious types of brachial plexus injury, ruptures occur when the nerve is stretched so severely, it is torn completely. These types of injuries will not heal on their own; nerve grafting may be the only treatment option.
  • Neuroma: Another type of stretch injury, neuroma can result in significant nerve damage, which can lead to scar tissue. This scar tissue may then press on the surrounding, unaffected nerves, leading to issues with arm movement and sensation.
  • Neurapraxia: Considered the mildest form of brachial plexus injury, neurapraxia is a “shock” injury in which the nerve is stretched but does not tear. Neurapraxia typically heals on its own within a few months, though physical therapy may be required.

Depending on how severe your child’s injuries are, he or she may require physical therapy, surgeries, and other forms of ongoing treatment to restore function.
