1. How to Enter
a. These rules govern "Hometown Hero" Promotion (the "Promotion") being conducted monthly by Charles G. Monnett III & & Associates (the "Firm") beginning at 12:01am Eastern Time ("ET") on August 1, 2015 and ending at approximately 10:00am ET on May 10, 2016.
b. To participate in the Promotion, you may enter the following method: log onto https://carolinalaw.com, click on the Hometown Hero logo and complete an official entry form including the name of the county, name of the teacher's school and the name of teacher. All entries must be received by 11:59am ET on the last day of each month during the contest period. Only one internet entry per person per email address per day is permitted. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address. All entries submitted become the sole property of the Firm and will not be acknowledged or returned. Use of any device to automate entry is prohibited. Proof of submission of an entry shall not be deemed proof of receipt by Firm. The Firm's computer is the official time keeping device for the Promotion. The Firm is not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties and other technological problems.
2. Eligibility Restrictions
a. The Promotion is open to all persons who are classroom teachers, 18 years of age or older and who reside in North Carolina. Employees of the Firm, its licensee, the licensee's parent, subsidiary and affiliated entities, the Firm's advertising and promotional agencies, its participating sponsors, the members of their immediate families (spouse, parent, sibling or child) and those living in the same household of each (whether related or not), are ineligible to win. This Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited.
b. The winner must provide valid government-issued photo identification and provide their complete address, date of birth and phone number to claim a prize.
c. The Firm will disqualify any entry from individuals who do not meet the eligibility requirements.
3. Prizes
a. Nine (9) qualifying prizes will be awarded in each county during the Promotion. Each qualifying prize includes the following: (i) one (1) $250 VISA gift card; and (ii) one (1) Pizza Party for up to 35 persons. The Approximate Retail Value ("ARV") of each qualifying prize is $400.00. The winners will be solely responsible for all taxes and all other fees and expenses not specified herein associated with the receipt and use of the prize. The Firm accepts no responsibility for repairing any real or supposed damage to any prize. The gift cards will be subject to the terms and conditions as set forth by the issuer of the gift cards. b. Prizes will be awarded to the winning teachers and not to the person who submitted the nominations. In the event that a winning teacher declines a prize, an alternate winner will be selected.
d. All prizes or prize certificates will be presented to the winning teacher (see schedule below). The winner will forfeit any prize or prize certificate not claimed within thirty (35) days of winning. No prizes will be mailed. The Firm is not responsible for the safe arrival of a prize or prize certificate.
e. There is no substitution, transfer or cash equivalent for prizes, except that the Firm may, at its sole discretion, substitute prizes or cash of comparable value. The prizes are expressly limited to the item(s) listed above and unless otherwise expressly specified, do not include taxes, gratuities or any other expenses. Other restrictions may apply.
4. Winner Selection and Notification
a. Decisions of the Firm management with respect to the Promotion are final.
b. Nine (9) qualifying prize winners per county will be selected during the Promotion. Qualifying prize winner will be selected the first Thursday of every month from September 2015 to May 2016 as explained in the list below in voting of all nominations received by 11:59pm ET on the last day of each month. Winning nominees (teachers) will be notified by phone at approximately 9:00 am ET on the judging dates listed and will be recognized on the dates listed below. Each month's promotion is considered a separate promotion with no votes carrying over to subsequent months.
c. Odds of winning a qualifying prize depend upon the number of teachers nominated at the time of each entry deadline.
d. Winners do not need to be clients of the Firm or be present to win.
e. Qualifying prize winners must execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form within ten (10) days of notification attempt or prize will be forfeited and an alternate winner may be chosen by selecting the entry with the next highest number of votes. If there is a tie, the winner will be selected in a random drawing of all tied entries.
5. Conditions
a. One Hometown Hero award per teacher per school year.
b. By participating in the Promotion, the winner agrees to have the winner's name, voice and likeness used in any advertising or broadcasting material relating to the Promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. Prior to awarding any prize or prize certificate, the Firm, in its sole discretion, may require Promotion winner to sign a liability release, agreeing to release and hold harmless the Firm, its licensee, the licensee's parent, subsidiary and affiliated entities, their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Promotion.
d. If for any reason this Promotion cannot be executed as planned, including, but not limited to, as a result of infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Firm that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Promotion, or if the Promotion is compromised or becomes technically corrupted in any way, electronically or otherwise, the Firm reserves the right to cancel, terminate or modify the Promotion. If the Promotion is terminated before the original end date, the Firm will select the winners by random drawing from among all eligible non-suspect entries received as of the termination time/date.
e. The Firm, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of the Firm's website. Failure to comply with the rules of the Promotion may result in disqualification and/or forfeiture of any prize or prizes. If the Firm makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a Promotion, the Firm reserves the right to disqualify that entrant from entering and/or winning future Promotions and to prosecute and seek damages to the fullest extent permitted by law.
f. The Firm reserves the right to make changes in the rules of the Promotion, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of the Firm, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Firm reserves the right, but not the obligation, to cancel or modify the Promotion and shall not be required to award a substitute prize.
g. The Firm is not responsible for typographical or other errors in the printing, the offering or the administration of the Promotion or in the announcement of a prize.
Rules and the Winner List (when completed) shall also be available during regular business hours at the main offices of the Firm and may be posted online.
