2010: $1.5 million arbitration award for man who suffered a mild traumatic brain injury when the tractor trailer he was driving was struck by a car that ran a stop sign.
2009: Alamance County, NC - $2.5 million recovery for a woman who sustained a traumatic brain injury after her vehicle was struck by a commercial truck while stopped for traffic in a construction zone. A substantial reduction of the workers' compensation lien was negotiated and the lien was resolved for a total payment of $100,000. The woman will continue to receive weekly workers' compensation benefits and all future medical expenses will be paid by the workers compensation insurance carrier.
2009: Mecklenburg County, North Carolina - $750,000 confidential settlement for wrongful death of 10 year old autistic child who wandered away from long term care facility and drowned.
2009: Mecklenburg County, North Carolina - $700,000 confidential settlement for wrongful death of man as a result of errors during medical treatment.
2009: $379,000 confidential settlement for medication and monitoring errors after a heart attack patient was transferred from rural western North Carolina to a major medical center in Tennessee.
2008: North Carolina - $9.075M confidential settlement for family struck by underage impaired driver who had purchased alcohol at a convenience store shortly before crash. The collision resulted in the death of an unborn child, severe brain injury to a 4-year-old child and internal and orthopedic injuries to the mother and other occupants in the car.
2008: Obion County, Tennessee - $2,328,000 jury verdict on behalf of man injured by defective Bow-Flex machine. The verdict included $2M in punitive damages.
2008: Catawba County, North Carolina - $975,000 recovery for the wrongful death of a truck driver killed in a collision on I-40. He was survived by his wife and by 2 adult children from his first marriage.
2008: Mecklenburg County, North Carolina - $555,000 settlement for man who sustained back injury when elevator malfunctioned and rapidly descended between floors.
2008: South Carolina - $575,000 confidential settlement for wrongful death of a child injured by defective automobile.
2008: Jackson, Tennessee - $425,000 recovery for wrongful death of man as a result of errors during medical treatment.
2008: Mecklenburg County, North Carolina - $350,000 arbitration award for young man who sustained hip fracture and other orthopedic injuries when the van he was riding in was struck by a truck on I-77.
2008: Gaston County-North Carolina - $350,000 recovery for 4 year old child who sustained head injuries when he fell from the high diving board at a local recreational facility.
2008: Catawba County- North Carolina - $325,000 recovery for woman who sustained injury to her colon during surgery to repair a hernia.
2007: $465,000 recovery for the estate of unmarried, Hispanic male with no children. The decedent was killed by a construction vehicle which backed over him while he working on a job site for an excavation company. The recovery included $117,000 in workers' compensation death benefits.
2007: Mecklenburg County, NC - $1.25 million workers' compensation settlement for man who sustained a traumatic brain injury as a result of an exploding tire and rim.
2006: South Carolina - $3.375 million confidential settlement on behalf of a child with severe visual impairments resulting from the failure to properly diagnose retinopathy of prematurity in a new born child.
2006: Mecklenburg County, NC-$10 million verdict for child who sustained severe traumatic brain injury in an automobile accident. Both responsibility for the accident and the amount of damages owed were contested. This is believed to be the largest verdict ever in Mecklenburg County Superior Court arising from an car accident. Both defendants were represented by experienced insurance defense counsel. State Farm Mutual Automobile Insurance Company had issued a $100,000 liability policy to one of the drivers involved. At a court ordered mediation settlement conference State Farm had refused to make any settlement offer whatsoever to the injured child. Instead, State Farm denied it was obligated to pay any amount whatsoever. State Farm then made a verbal promise to its insured that it would pay any verdict that was returned in the case. After the verdict State Farm filed an appeal on behalf of its insured but failed to post an appeal bond. A second lawsuit was then filed against State Farm to force the insurance company to pay the entire amount of the verdict. The case was settled shortly after the second case was filed for $11,248,111.
2006: Guilford County, NC - $2.5 workers' compensation settlement for man who sustained a traumatic brain injury while employed by a logging company.
2006: Mecklenburg County, NC - $1.73 million workers' compensation settlement for undocumented worker paralyzed in a fall from a scaffold.
2006: York County, SC - $350,000 settlement for man with hypoxic brain injury and neurologic disorder after fall into open sewer line. Workers' compensation claim was resolved for an additional $500,000 payment and waiver of workers' compensation lien.
2005: Mecklenburg County, NC - $1.3 million arbitration award for man with mild traumatic brain injury as a result of a motor vehicle collision. There was no loss of consciousness at the time of the collision.
2005: York County, SC - $2.3 million settlement for estate of man killed in collision with truck. Case was resolved in association with local counsel in the state of South Carolina.
2005: Mecklenburg County, NC - $590,000 confidential settlement for death of infant and injury to mother as a result of medical errors during labor and delivery.
2005: Mecklenburg County, NC - $450,000 judgment for woman with orthopedic injuries following head on collision with impaired driver.
2005: West Virginia - $300,000 (policy limits) settlement for woman with orthopedic injuries following head on collision in the state of West Virginia.
2005: Mecklenburg County, NC - $250,000 workers' compensation settlement for man who sustained mild traumatic brain injury after falling from roof at work.
